HC rejects CBI, ED probe in forest land acquisition case

The division bench of Jharkhand High Court comprising Chief Justice MS Sonak and Justice Rajesh Shankar rejected the petition seeking an investigation by the CBI (Central Bureau of Investigation) or ED (Enforcement Directorate) in the alleged illegal sale and encroachment of forest land in Hazaribagh. The court clarified that an order for an investigation by central agencies cannot be passed merely based on allegations, especially when sufficient supporting evidence is unavailable.
The court made serious observations regarding the petitioner’s motives and credibility, stating that most of the allegations leveled by the petitioner do not appear to be substantiated prima facie (at first sight). Based on the records presented before the court, the claim regarding the illegal transfer of 450 acres of forest land could not be verified during the investigation. No concrete evidence was produced to support the allegations of a nexus/collusion between forest officials and other authorities.
The High Court noted in its order that the forest department and other concerned authorities were already investigating the alleged encroachment and transfer of forest land even before the PIL (Public Interest Litigation) was filed. Necessary action has also been initiated wherever signs of irregularities were found.
The bench made it clear that this order should not be construed as a ‘clean cheat’ (clean chit) to anyone. If an investigation or legal action is pending in any matter, it will continue to proceed in accordance with the law. The High Court disposed of the PIL while making serious remarks about the intent and credibility of the petitioner.
